Privacy Policy

1. COMMITMENT TO THE PROTECTION OF PERSONAL INFORMATION

EAD Design (collectively, “EAD” or “we”), are committed to protecting the secrecy, confidentiality, accuracy and security of the personal information they hold. This policy describes how EAD collects, uses, discloses and protects the personal information of individuals who do business with or work for EAD.

“Personal information” means information about an identifiable individual or that allows a person’s identity to be directly or indirectly established, such as name, mailing address or email address, age, gender, personal financial information or identification numbers.

EAD is committed to collecting, using and disclosing any personal information responsibly, only within the limits of the consent given and to the extent necessary to carry out its professional activities. It also endeavors to limit the amount of information it collects about individuals or organizations to that which is necessary to carry out its professional activities and for any other reason defined in this policy.

2. NATURE OF PERSONAL INFORMATION COLLECTED

EAD collects and processes different types of personal information in the normal course of its business, for example:

  • contact information, name, mailing address or email address and telephone number;
  • financial information.

The majority of this information is collected directly from the individual, but some may come from third parties.

3. REASONS WHY EAD COLLECTS, USES AND DISCLOSES PERSONAL INFORMATION

A. General

EAD may collect, use or disclose personal information to:

  • communicate with a client, supplier or third party, offer them services and manage their file;
  • ensure the billing and accounting management of its services;
  • any other reason to which you have consented;
  • any other reason permitted or required by applicable laws and regulations.

B. Personal information collected on the Website

EAD’s Internet servers automatically collect the IP address, date and time of each visit to the Website, the pages viewed, the documents downloaded, the searches performed and the URL link used to access the site. This information is used for troubleshooting the Website and correcting operational problems.

EAD uses cookies to monitor traffic and usage of its site and related information on the site. Cookies are small pieces of information that are stored on your computer to allow your browser to remember certain information about a website. Most browsers automatically accept cookies, but can be configured to refuse them or report their presence. Cookies are also used to customize the interface to speed up navigation and make the user experience more efficient. Without cookies, these functions are impossible. When a user accesses a website, a cookie lets us know if it is their first visit. EAD uses cookies to learn about the site functions most used by a user and thus recommend other similar functions to them.

EAD also uses Google Analytics, Google Tag Manager and Google Ads. Finally, third-party providers may use cookies to serve ads to users who visit EAD’s site. To disable personalized advertising from Google, visit the Google Ads Settings page.

No personal information is extracted from this process, and this data is not shared with any third party.

By browsing EAD’s site, the user consents to the collection, use and disclosure of information collected about him or her on the site, in accordance with this privacy policy, or that he or she provides himself or herself on this site, such as his or her contact information when subscribing to a newsletter.

Certain pages of the site, such as the credit card payment page, may contain links to other sites. EAD cannot be held responsible for the privacy practices of third parties and strongly recommends that the user read the privacy policy of these third parties before providing them with personal information.

4. AUTHORIZATION TO USE PERSONAL INFORMATION

When someone provides EAD with the personal information of another person, they represent that they have obtained that person’s prior consent for EAD to collect, use and disclose their personal information for the purposes set out in this policy.

Everyone has the choice of whether or not to provide personal information to EAD. However, any request must be accompanied by certain information so that EAD is able to respond to the request. Accordingly, the individual authorizes EAD to collect and use this information for this purpose, and to disclose it to third parties. The individual also authorizes EAD to use and retain the personal information for as long as necessary for the aforementioned purposes. The authorization remains in effect even after the end of the relationship with EAD, unless the individual withdraws it in writing.

There are certain exceptions in the law under which EAD is not required to obtain consent or explain its reasons for collecting, using or disclosing personal information. These exceptions include emergency situations that endanger the life, health or safety of an individual. For a more comprehensive list of exceptions, contact the Privacy Officer listed below.

Except as permitted by law, personal information is only used for the purposes for which it was collected. If, for any reason, EAD needs to use or disclose personal information for a purpose other than that originally stated, it will take the necessary steps to obtain the consent of the individual concerned.

5. DISCLOSURE OF PERSONAL INFORMATION

In the course of conducting its operations, EAD may need to disclose personal information collected to other service providers or agents acting on its behalf. When EAD discloses personal information to third parties (for example, to a technology service provider), it enters into agreements with those third parties stipulating the permitted uses and including a commitment from the third parties to provide a level of protection for personal information comparable to that of EAD.

EAD does not sell, rent or trade customer lists or any other personal information.

6. SAFEGUARDS FOR PROTECTING PERSONAL INFORMATION

EAD keeps each individual’s personal information in a digital file. This file is stored in a properly protected cloud infrastructure.

EAD uses all appropriate physical, electronic and procedural safeguards to protect its systems and all personal information it holds from unauthorized use or access. All security measures are tailored to the sensitivity of the information collected.

The contract that service providers and agents enter into with EAD includes an obligation to protect the confidentiality of information provided by customers and a prohibition on using this data for unauthorized purposes.

Employees are subject to strict standards and policies to ensure that personal information is protected and treated with care and respect.

EAD takes all appropriate measures to protect personal information. However, there are inherent risks in exchanging or protecting data through any form of communication (electronic or otherwise), including the use of commercial or public software and services (often referred to as the “cloud”). Any transmission of personal information may be intercepted, accidentally or deliberately, by third parties.

Our servers are located in Canada, but EAD may use commercial and public software and services hosted elsewhere to store, transmit or process certain data. When data is stored outside of Canada, it may be accessible to foreign law enforcement, governments or courts.

7. CONTACT INFORMATION

Any individual may contact EAD’s Privacy Officer for more information about its privacy policies and procedures, to request access to certain personal information EAD may hold about them, or with any questions or concerns. EAD reserves the right to request personal information from any individual to verify their identity.

EAD will respond promptly and make every effort to address any issues raised. However, it may not always be possible to provide certain personal information, as the right of access to information is not absolute. For example, it will not be able to provide information that would disclose personal information about another person or confidential business information. If it is not possible to provide the requested information, EAD will inform the individual in writing, explain why and indicate possible recourse.
